Texas sues Biden admin over decision to end Title 42 expulsions

The Biden administration is facing another southern U.S. border-related lawsuit.

The Daily Wire reports that the state of Texas has decided to sue the Biden administration over its decision to end Title 42 expulsions. 

Title 42 is the Trump-era policy that the federal government has used to expel illegal immigrants during the coronavirus pandemic. The policy is scheduled to come to an end in late May, and the Biden administration has made it known that it has no plan to stop it from doing so.

As a result, the Biden administration is expecting another southern border surge. It believes that the number of illegal entries to America, via the southern border, could jump from 8,000 per day to as many as 18,000 per day.

The lawsuit

Texas is one of the states that has suffered the most because of the Biden administration’s open-border approach to the southern border. It has been taken steps to get out ahead of another surge, and the latest step is this lawsuit, which has been brought by Texas Attorney General Ken Paxton (R).

Paxton, in the lawsuit, alleges, among other things, that the Biden administration failed to follow the Administrative Procedure Act’s (APA) notice-and-comment requirements.

The lawsuit reads:

[The Biden adminsitration] failed to follow the Administrative Procedure Act in attempting this destructive rescission of Title 42. Without justification or concern for Texans, the Defendants unlawfully disregarded the APA’s notice-and-comment requirements, refused to consider numerous factors of crucial importance to their rulemaking, and laid bare the incoherence of their decision-making.

Paxton released a statement in which he explained the importance of Title 42 to border states, such as Texas.

“We already have a massive influx of illegals,” Paxton said. “This was the only thing left keeping it from being even worse. Anything we can do to slow the border crisis from expanding when the Biden administration clearly wants it to be expanded, we have to do.”

Looking forward

It ought to be noted that Paxton’s lawsuit is separate from the other lawsuit in which 21 Republican-led states are suing the Biden administration for its decision to end Title 42 expulsions. Republicans are clearly trying to attack the issue from as many angles as possible.

One interesting fact is that a number of Democrats have also come out in favor of keeping Title 42 in place. The Biden administration, however, is adamant about putting an end to the policy.

Now, we will have to see how it plays out in the courts.
