A federal judge has permanently blocked one of President Donald Trump’s Executive Orders. This decision is causing grave concern among citizens, particularly those who reside along the southern US border.
US District Court Judge William Orrick blocked President Trump’s Executive Order that cut funding for sanctuary cities, according to NBC News. The reason this is causing concern is due to the fallout countries around the world are facing due to mass immigration. It is believed that blocking this Executive Order will make it more likely that illegal immigrants will fearlessly cross the border.
Judge Orrick came to his conclusion on the grounds that the Executive Order applies to a broad range of funding. Furthermore, the Judge argued that President Trump is unable to adjust conditions on spending previously approved by Congress.
The same judge had previously made the same argument in a ruling that put a hold on another one of President Trump’s Executive Orders based around sanctuary cities. The Trump administration has since appealed the Judge’s decision to the 9th US Circuit Court of Appeals.
Department of Justice spokesman Devin O’Malley said, “The District Court exceeded its authority today when it barred the President from instructing his cabinet members to enforce existing law,” with regard to the President’s order being blocked.
O’Malley continued, “The Justice Department will vindicate the President’s lawful authority to direct the executive branch.” In other words, the White House is not going to give up on this Executive Order without a fight.
The Judge’s decision occurred when two lawsuits were brought forward by San Francisco and Santa Clara in California. While the Justice Department fights for the proper ruling, Liberals are celebrating their small victory.
Dennis Herrea, the City Attorney for San Francisco, declared that the judge’s ruling was “a victory for the American people and the rule of law.” Yet the ruling smacked down the rule of law and President Trump’s Executive Branch powers.
“President Trump might be able to tweet whatever comes to mind, but he can’t grant himself new authority because he feels like it,” Herrea proudly continued, ignoring the glaring irony. The battle for normalizing illegal immigration is particularly strong in California, mainly due to it being on the border and a Blue state.
Lawyers within the DOJ claimed in April that the order would apply to less than one million dollars for Santa Clara County. Judge Orrick disagreed with the lawyer’s statement.
Activist judges have been thwarting Pres. Trump’s immigration and border security measures ever since their implementation. Are these judges’ actions unconstitutional?
Instead, Judge Orrick argued, the ruling would “reach all federal grants” and could put hundreds of millions of dollars at risk in both San Francisco and Santa Clara. Orrick cited Attorney General Jeff Sessions’ statements as proof that millions of dollars could be at stake.
President Trump’s administration also moved forward to withhold funding to law enforcement grants to sanctuary cities. This decision is bringing a brand new set of lawsuits in an attempt to ban the President’s Executive Order. Americans are concerned about the implications that this could have on the border. If illegal immigrants can continue to cross the border without consequences, this presents a danger for the American citizens living in these communities.
